These General Terms and Conditions of Sale alone govern relations between MOTTEZ, a simplified joint-stock company with a capital of €152,449, registered in the Lille Company Register under number 303 321 152, and customers wishing to place orders on the www.chariotderandonnee.com site.
These terms and conditions exclude any other terms and conditions, in particular those in force within MOTTEZ SAS.

The customer places his/her order according to the procedure currently operated on the site and confirms it, displayed in summary form.

The customer is required to supply any information necessary for delivery: title, surname, first name, address, access code, floor, building number and any other necessary information, in particular a fixed line or mobile phone number where the customer can be reached during the day, in case an appointment is necessary.

When registering in Open an account and/or when placing an initial order, necessitating customer registration in Open an account, the customer must enter his/her title, name, first name, full address, email address and password. When ordering, the customer can indicate his/her willingness or otherwise to receive sales offers from www.chariotderandonnee.com and/or its partners by writing a comment in the order. The password with a minimum of six characters is strictly personal.

Each time the customer visits the site, when he/she accesses his/her personal data in Access my Account or
when placing an order, the customer will identify him/herself beforehand by entering his/her identifier and
password.

After selecting products and identifying him/herself, the customer chooses the delivery method, delivery
address and payment method.

The customer must complete all the required fields on the electronic form.

The order is summarised on a screen entitled MY BASKET, which may be viewed at any moment, showing
all the items on the order and indicating the total amount including delivery costs, depending on the delivery
method chosen.

The customer may come back to the order, add to it, change it or cancel it, until it is confirmed. The customer
confirms the order by clicking on CONFIRM MY BASKET.


The customer chooses a parcel delivery or collection address and confirms the choice by clicking on CONFIRM MY PLACE OF DELIVERY.

The customer chooses his/her payment method and confirms by clicking on CONFIRM MY PAYMENT METHOD.

Once the customer has confirmed the order, delivery and payment methods, he/she may no longer modify
or cancel it.

Within 24 working hours of the order being registered, the customer will receive an email, confirming that the order
placed has been registered.

If such an email is not received within the indicated time, the customer should contact www.chariotderandonnee.com, since it may be that it was not possible to register the order for technical
reasons.

Information registered by the www.chariotderandonnee.com system is considered as proof of an order being
placed by the customer (content and date).


Confirmation of the order by www.chariotderandonnee.com



The order will not be considered as fixed and firm until confirmed by chariotderandonnee.com. The order confirmation will state the items and quantities ordered, the unit price for each item and the total price for the order including VAT (and also any packing and shipping costs). This is the price which will be invoiced to the customer, expressed in euros and including VAT.

The customer’s order will only be considered to be accepted after confirmation by www.chariotderandonnee.com. Some orders may require additional information from customers. In that case, the customer will be informed of supporting documents to be sent by email, letter or fax to
www.chariotderandonnee.com, in order for the order to be confirmed. www.chariotderandonnee.com reserves the right to cancel the order in the event of non-receipt of these
supporting documents or the receipt of unacceptable documents. Such requests will be made by email, letter
or telephone.

Additional requests may be made to customers by email. www.chariotderandonnee.com undertakes to inform customers by any means it chooses, notably in the event of problems with supplying products, unusual orders, foreseeable difficulties, product non-availability, payment problems or non-receipt of supporting documents.


Availability



Our product offers and prices are valid while they appear on the site, so long as there is stock available. If a product is temporarily unavailable, this will be indicated on the product page.

Prices



The prices shown are net prices in euros, inclusive of all applicable taxes.
An invoice, for use as a guarantee, is sent with the product when shipped.


Payment



The customer may make payment:
- by bank card
- by bank transfer (please ask MOTTEZ bank details at fmottez@mottez.com)
Customer payments will be banked following dispatch of the goods to the customer.
The card is debited following dispatch of the order.


Shipping costs



Delivery is included in the price for deliveries within metropolitan France.
For deliveries other than to metropolitan France, see the delivery costs table.


Invoicing



The invoice is sent by email to the address given by the customer, when the order is shipped and at the latest
when it is delivered. The customer may also find all his/her orders/communications in his/her personal space by clicking on Go to my Account, after identifying him/herself.


Delivery



Delivery within metropolitan France and Monaco cannot be made to university campuses, military barracks, P.O. boxes and hotels, where it is not always possible to obtain a signature.
For all other countries and Corsica, delivery is subject to additional charges.

Saturday delivery is not available.

Products are delivered to the delivery address which you entered when placing the order.

Try to use an address where there is always someone present to receive the package, for example, a business address.

Deliveries are made by a transport company.

Please allow an average of five days for delivery within France. Bank holidays and public holidays should be added to delivery times indicated.

Deliveries to Corsica and islands within metropolitan France may take longer than delivery times stated on the www.chariotderandonnee.com site. These additional delivery times are due to the particular difficulty associated with delivering to islands.

www.chariotderandonnee.com cannot be held liable for the consequences of any event outside its control, in
particular cases of force majeure or acts by the transport company which might delay or prevent or the delivery
of products ordered.

Delivery delays or failure to perform the contract can under no circumstances result in the payment of damages to the customer.

When placing an order, the customer undertakes to provide all the information necessary to ensure its smooth execution, in particular a telephone number which the transport company may contact during the day.

The customer undertakes on behalf of him/herself or the consignee (mainly where the goods are sent as a present) to take delivery of the goods at the address indicated in the order.

Upon delivery, the customer or consignee for the product must be able, if so asked, to produce proof of identity.

After opening and checking the contents of the package(s), the customer undertakes to sign the delivery note presented by the transport company.

In the event of a problem, (damaged package, missing products, etc.), the customer will note the reasons for complaint clearly on the delivery note, ask the transport company driver to sign it and keep a copy of the document. Writing “accepted subject to unpacking” has no legal force.

Reservations must be advised to the transport company and to www.chariotderandonnee.com by registered letter with confirmation of receipt within three days of receipt of the product.

In the event of damage, the customer should refuse delivery and indicate “refused due to damage” on the delivery note; failure to do so will render any action against the transport company impossible.



Definition of damage



By signing the delivery note and not making any precise reservations and by accepting the products, the customer acknowledges that he/she has received the goods in a completely satisfactory condition. In the event of the delivery not being consistent with the order as regards quality or quantity, the customer must inform www.chariotderandonnee.com, indicating the order reference, by calling our customer service staff on +33.3.20.10.37.73 or by emailing fmottez@mottez.com

When you order several products at the same time and there are different delivery times, the delivery time for the order will be based on the longest delivery time.

www.chariotderandonnee.com cannot be held liable for the consequences of a transport delay.

If there is a dispatch delay, you will be advised by email. In that case, and until the product is dispatched, you may still cancel your order, since you are not charged until shipment is made.

Where payment is made by cheque, the order will be processed upon receipt of the cheque. Consequently, the delivery times applicable are those on the day the cheque is received and may therefore differ from those in force on the day the order was placed.


Right to cancel and to return products



By application of article L 121-20 of the French Consumer Code (Code de la Consommation), the consumer has a period of seven clear days to exercise a right to cancel without having to give a reason or pay a penalty, except the cost of return.

www.chariotderandonnee.com allows customers a period of fifteen calendar days to exercise the right to cancel. Return costs are the customer’s responsibility.

Where a customer exercises his/her right of cancellation, www.chariotderandonnee.com undertakes to refund the customer within 15 days at the latest, following receipt of the returned product(s). Refund will be made by crediting the bank account of the card used for payment.

To make the return, the customer must have previously identified him/herself on the www.chariotderandonnee.com website and accessed his/her account. The customer must state the product(s) concerned by a return due to cancellation.

Products must be returned in their original packaging, in perfect condition, unused and accompanied by any accessories and instruction manuals, the invoice(s) concerned and the returns authorisation, duly completed, dated and signed. Articles returned incomplete, damaged, used or dirtied will not be accepted.

Contractual guaranties do not cover:

- Breakdowns linked to accessories (supply cables, etc.),
- Faults and their consequences resulting from any external causes,
- Work and repairs carried out on the product by third parties.

In any case, the customer is covered by legal guarantees provided for in the provisions below:

Article L211-4 of the French Consumer Code
The seller is bound to supply a product conforming to the contract and to respond to the failure of a product to conform, existing at the moment of delivery.

Article L211-12 of the French Consumer Code
Action for failure to conform lapses two years from the delivery of the product.

Article 1641 of the French Civil Code
The seller is legally responsible for any hidden defects in an item which render it unfit for the use for which it was intended, or which would so diminish this use, that the buyer would not have bought it, or would only have paid a lesser price, if he/she had known.

Article 1648, para. 1 of the French Civil Code
Any action for hidden defects must be brought by the purchaser within two years of discovery of the defect.

Applicable law – disputes



These General Terms and Conditions are subject to French law. In a situation where one of the clauses in this contract was rendered null and void by a change in legislation or regulations, that would in no way affect the validity of or compliance with these General Terms and Conditions of Sale. The language of the contract is French.

In the event of a dispute with a dealer relating to the interpretation, performance or validity of these General Terms and Conditions of Sale, the competent court will be the Tribunal de Commerce (commercial court) in Lille.
